I will going for a professional tomorrow.
Original problem
The band is tight but 40 band is to loose. The cups seem to be a little small on the left side.I have had a lumpectomy on the right breast so it is somewhat smaller.

helpfulNo. It's cutting into your tissue and giving you quad-boobs. The band is probably fine, because it will break in with wear, but it's squishing your boobs.. Try going up at least one cup size, and perhaps try 3 part cups that will provide more uplift and shaping. This bra to me looks like its cramming your boobs into too small cups and then pulling them too close to your torso. That's not a bra, it's a straitjacket!

I would definitely try a smaller band size then. The band should be snug enough that (if the cup is big enough to hold all your breast tissue) nothing really moves.

helpfulCan you pull the bra up anymore?
Are you all swooped and scooped at the sides? It possibly looks like the wire might be sat on breast tissue? Is it uncomfortable in any way?
And I think you should go up a cupsize, you should always fit your bigger boob (you can compensate the other by tightening the strap a bit more) and I can see quadboob here.

helpfulIt looks too tight in the front and center part of the bra. Also the cups are too small on top inner part. I would go up 1 cup size and see if that fits better.

Thanks to all of you for the great help. It seems I am no longer DDD.
Because the other bra also a tee shirt bra I bought at the same time is to small as well.

helpfulDefinitely not. A few things:
For the quadboobing: You should try going up at least 1 cup size. Going up a band size (38 to 40) is not going to significantly help the quadboobing issue.
It looks like the bra is sitting a little low. Is the underwire hitting your inframammary fold (where the boob and ribs meet)? If it is sitting below that, the band is probably too loose.
Based on your profile, it looks like you have tried DDDs in several different bands. When was the last time you measured yourself? You should measure and post your underbust snug, bust standing, and bust leaning measurements here. Maybe we can figure out a better size for you.

Thanks for the help. I have a significant amount of breast tissue under my arms, this makes it very hard to find a bra that givers me the lift and support ( without the lift and support) I have a lot of pain in my shoulders ,neck and upper back.The problem is the breast tissue under my arms doesn't stay put even after swooping a scooping. Thank you for suggesting a three part cup one size up.
